1. Pursuant to the provisions of reference (a) Subject, hereinafter
referred to as Petitioner, filed enclosure (1) with this Board
requesting, in effect, that the applicable naval record be corrected
to show Petitioner is entitled to Basic Allowance for Housing (BAH) at
the previous Permanent Duty Station (PDS) rate based on a close
proximity move.
2. The Board, consisting of Mr. Ruskin, Mr. Exnicios, and Mr. George,
reviewed Petitioner's allegations of error and injustice on
22 September 2014 and, pursuant to its regulations, determined that
the corrective action indicated below should be taken on the available
evidence of record. Documentary material considered by the Board
consisted of the enclosures, naval records, and applicable statutes,
regulations and policies.

3. The Board, having reviewed all the facts of record p a

Petitioner’s allegations of error and injustice, nds as f

a. Before applying to this Board, Petitioner exhausted all
administrative remedies available under existing law and regulations
within the Department of the Navy.
b. In correspondence attached as enclosure (2), the office
having cognizance over the subject matter addressed in Petitioner's
application has commented to the effect that the request has merit and
warrants favorable action.
CONCLUSION
Upon review and consideration of all the evidence of record, and
especially in light of the contents of enclosure (2), the Board finds
the existence of an injustice warranting the following corrective
action.
RECOMMENDATION:
That Petitioner’s naval record be corrected, where appropriate, to
show that:
a. Petitioner recelved BUPERS Order 0045 woedl£i Gatien, SA. of
about 15 August 2016 vice 12 September 2013, stating the following:
"Per your request, this order is issued with no entitlement or funding
for relocation of dependents or movement of household goods. If you
receive approval for BAH at the previous duty station, you will
forfeit the authorization for all travel and transportation allowances
for the entire assignment per NAVADMIN 101/10."
b. Petitioner is authorized Basic Allowance for Housing (BAH)
with dependents at the Indian Head NAVORDSTA, MD 20640 rate from 16
September 2013 to present. Note: Petitioner received BUPERS Order
0043, on or about 4 January 2013. Furthermore, Petitioner transferred
from Indian Head NAVORDSTA, MD on or about 16 August 2013, and arrived
to NBRHLTHCLINIC Navswc, Dahlgren, VA on 16 September 2013.
c. A copy of this Report of Proceedings will be filed in
Petitioner’s naval record.
4. It is certified that quorum was present at the Board's review and
deliberations, and that the foregoing is ajtrue and complete record of
the Board's proceedings in the above entit/jed matter.

of the revised Procedures of the Board for Correction of Naval Records
